Probate
The Executors appointed under a valid Will are responsible on the death of the testator for ensuring that the terms of the Will are followed in all respects. Statutory rules set out what must be done in the event that there is no Will
The Executors’ duties are to deal with the deceased’s assets (bank accounts, shares and life policies for example) and debts which have to be settled. The Executors must also arrange for the Inland Revenue to be informed of the value of the estate and must pay any assessed Inheritance Tax due on the estate. In some cases the Executors will have to report to the Capital Taxes Office.
Our role as professional executors is to take the burden of the paper work from the recently bereaved next of kin and to be sympathetic and understanding in our approach.
We will:
- take full instructions and act promptly in accordance with them
- keep Executors and Beneficiaries regularly informed
- offer comprehensive advice and assistance in relation to any major steps that need to be taken in dealing with someone’s Estate
- maintain a fair and open approach to our fees and the other expenses of the estate
- account to the local authority for repayment of nursing home fees
- account to beneficiaries for any specific gifts of property or sums of money and assisting with distribution of the remaining funds.
- advise on trusts established by the Will
In the first instance, please ask for Ann Matthews or Ian Wessels for advice.
